Terms of Service

Last updated: June 2025

1. What Bikeway Is

Bikeway operates an open marketplace platform (the "Platform") that connects individuals and businesses who wish to rent out bicycles, e-bikes, scooters, and cargo bikes ("Listers") with individuals seeking to rent such vehicles ("Renters"). Bikeway is not a party to any rental agreement entered into between Listers and Renters. All rental contracts are formed directly between the Lister and the Renter.

Bikeway does not own, operate, maintain, or inspect any vehicle listed on the Platform. The availability and condition of any vehicle is solely the responsibility of the Lister. By accessing or using the Platform you agree to these Terms of Service in full.

2. Lister Responsibilities

As a Lister, you represent and warrant that each vehicle you list on the Platform:

  • Is in a safe and roadworthy condition at the time of each rental, with functioning brakes, lights (where required), and tyres.
  • Complies with all applicable local laws and regulations governing its use on public roads or paths.
  • Is accurately described in your listing, including vehicle type, condition, and any relevant limitations or defects.
  • Is insured, where required by law, for the jurisdiction in which it is listed. Bikeway does not provide insurance of any kind. Obtaining appropriate coverage is solely your responsibility.

You agree not to list vehicles that are stolen, under finance agreements that prohibit rental, or otherwise encumbered. You are solely responsible for complying with local permit requirements for commercial rental activity. Bikeway may remove any listing that violates these Terms or that receives substantiated complaints, without prior notice.

3. Renter Responsibilities

As a Renter, you agree that:

  • You ride at your own risk. You are responsible for your own safety, including wearing appropriate protective equipment such as a helmet where recommended or required by law.
  • You will inspect the vehicle before use and report any pre-existing damage to the Lister prior to departing.
  • You will return the vehicle in the same condition in which it was provided, at the agreed time and location.
  • Any damage, loss, or theft occurring during the rental period is your financial responsibility unless otherwise agreed in writing with the Lister.
  • You will pay the rental fee and deposit as agreed. Failure to return a vehicle may result in forfeiture of the deposit and further civil liability.

You must be of legal age to enter into a binding contract in your jurisdiction. You must possess any licence required by local law to operate the vehicle you rent.

4. Payments and Fees

All payments on the Platform are processed by Stripe, Inc. ("Stripe") through Stripe Connect. By completing a booking, you authorise Stripe to charge your payment method for the agreed rental amount plus a platform service fee of 10% of the rental value (excluding deposit).

At the time of booking, Stripe places an authorisation hold on the Renter's payment method equal to the deposit amount specified in the listing. This hold is not a charge; no funds are debited for the deposit unless a claim is raised by the Lister within 48 hours of the vehicle's agreed return. If no claim is raised within this window, the hold is released automatically.

Rental proceeds, net of the platform fee, are released to the Lister's Stripe Express account after the booking is marked complete. Bikeway does not hold funds for extended periods and is not a financial institution. All refund queries and payment disputes should be raised through the Platform within 48 hours of the rental end date.

5. Liability Disclaimer

IMPORTANT — LIMITATION OF LIABILITY AND NO INSURANCE

Bikeway provides no insurance coverage of any kind for any vehicle, Lister, Renter, or third party. Bikeway is not liable for any personal injury, death, property damage, theft, mechanical failure, or loss — whether direct, indirect, incidental, or consequential — arising from or related to any rental transacted through the Platform.

All disputes arising from a rental, including disputes over vehicle condition, damage, injury, or payment, are between the Lister and the Renter exclusively. Bikeway provides a technology platform only. To the maximum extent permitted by applicable law, Bikeway's aggregate liability to any user for any claim shall not exceed the platform fees collected from that user in the 30 days preceding the claim.

6. Dispute Resolution

Listers and Renters are encouraged to resolve disputes directly and in good faith. In the event of a deposit dispute, either party may open a dispute ticket through the Platform within 48 hours of the rental end date.

Bikeway may, at its sole discretion, review evidence submitted by both parties and make a non-binding recommendation regarding deposit release. Bikeway reserves the right to release or retain deposit funds based on the evidence provided, but assumes no obligation to mediate and accepts no liability for the outcome of any dispute resolution process. Bikeway's decision in deposit matters is final for the purposes of the Platform.

Nothing in these Terms prevents either party from pursuing legal remedies through appropriate courts or arbitration bodies in their jurisdiction.

7. Account Termination

Bikeway reserves the right to suspend or permanently remove any listing or user account at any time, with or without notice, for any violation of these Terms of Service or for conduct that Bikeway determines, in its sole discretion, is harmful to other users, the Platform, or Bikeway's reputation.

You may delete your account at any time by contacting support@bikeway.app. Deletion removes your public profile and active listings. Booking records are retained for a minimum of 5 years for legal and accounting compliance.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of [Jurisdiction]. Any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

If you are a consumer resident in the European Union, you retain any mandatory protections afforded to you under the law of your country of residence that cannot be derogated from by contract.
